Terms and Conditions

1. Definitions

“Agreement” means the agreement executed between LegalMD and YOU.

“Legal MD” means M/s LegalMD Global Consulting Services Private Limited a company incorporated under the Companies Act, 1956 and having its registered office at 212, Okhla Industrial Estate, Phase 3, New Delhi – 110020.

“Medical Practitioner” means any person registered as a medical practitioner / medical specialist / center / nursing home / hospital in India and would also include institutions registered under the appropriate laws (Indian Medical Council Act, 1956); which shall include doctors, nursing homes, medical labs, dental centers, hospitals, etc.

“Claim” a demand or an assertion by YOU to the Insurance Company for compensation, payment or reimbursement for a loss under a contract or an injury in terms of the Policy. Or as defined in the insurance policy document.

“Insurance Broker” means ACE India Insurance Broker Services Limited, a company registered under the provisions of the Companies Act, 1956 and under the Insurance Regulatory and Development Authority Act, 1999.

“Insurance Company” means Iffco Tokio General Insurance Company Limited or New India Assurance Co. Limited, a company registered under the provisions of the Companies Act, 1956 and under the Insurance Regulatory and Development Authority Act, 1999.

“Medico-Legal Protection” means defense against any medico-legal risk/problem/cases/claims arising against YOU under any applicable law during the course of conducting YOUR business/profession.

“Policy” means the bundled professional indemnity insurance/errors and omissions insurance issued by the Insurance Company through the Insurance Broker (as part of a group policy issued exclusively for the members of Legal MD), towards Medico-Legal Protection offered and provided to YOU. Policy would be offered to YOU on standard policy terms and conditions agreed between YOU and Insurance Company. To avoid confusion, the legal costs for Medico Legal Protection & related Legal fees shall be covered by the amount receivable under a successful Claim from the insurance company and such shall be netted off against the final claim amount decided by a court of law or by negotiations or as the case may be. Its also made amply clear that LegalMD’s offerings are not insurance and the indemnity policy is offered a bundled offering for the benefit of the members. The members have choice to clarify on the same from the Insurance Company or Broker. Also LegalMD doesn’t earn or charge extra commission for the insurance policy.

“Services” means mutually agreed services provided to YOU by Legal MD under the Agreement, and shall also include the ‘PR Service’, Trainings on related subjects, Preventative Inputs. Its made clear that LegalMD charges an annual fee for providing a set list of services from external vendors & may not necessarily provide the services directly themselves. The main intent is to negotiate, facilitate, consult and decrease the hassle for the member linked to these issues.. To avoid confusion, the Services shall be rendered for cases involving medical negligence only, arising from acts post cheque clearing with Legal MD and a continued membership only.

“PR Service” means ‘crisis PR’ and ‘ethical marketing’ services provided to YOU for one day only in case of any claim filed during the valid membership with Legal MD, under the Agreement. The PR Service shall be provided by Legal MD’s partnered PR entity/agency.

“Terms” means these terms and conditions governing YOUR membership with Legal MD for provision of Services and the provisions of the Policy.

“YOU” or “YOUR” means any Medical Practitioner enrolled with Legal MD as a customer and having agreed to receive Services along with the Policy.

2. Services and Policy

YOU hereby agree to receive the Services subject to these Terms. The period to receive the Services shall start from the day of remittance of fee alongwith the execution of the Agreement in this regard, the Policy and other related documents. The Services are valid for a period of one year pursuant to receipt of the entire service fee. In the event of expiry of the period of the Services, if any case has been initiated against YOU, for which the treatment was initiated during the period of the Services, the Services with respect to such cases will be provided upto the validity of the services, i.e 1 year . Post that extension of services will entitle continuation of services, on best effort basis. However, cases initiated against YOU before obtaining membership for Services shall attract applicable pre-membership legal fee.

3. Cancellations and Refund

Membership cancellations received within 7 (Seven) (Legal MD Reserves the right to issue No-Refund) days of registration may be eligible to receive refund after deduction of insurance charges. Any cancellations received after the stated deadline will not be eligible for a refund. Cancellations will be accepted via e-mail on info@legalmd.in, and must be received by the stated cancellation deadline. All benefits and incentives received by YOU must be cancelled/returned to Legal MD. All refund requests must be made by YOU directly. Refunds will be credited back to YOUR account only. Please read these Terms, the Agreement, the Policy and all other ancillary documents to the Agreement carefully.

4. Exclusions

Legal MD shall not provide YOU Services in respect of the following or for any Claim arising directly or indirectly from or in connection with any of the following:

  • Non-Medico Legal Cases; and
  • Claims which are excluded by the Policy; and
  • Claims which are rejected by the Insurance Company.
  • Arising from cases or acts before sign-up (cheque clearing) with Legal MD or a post membership period (One Year from Date of Cheque Clearing).

5. Entire understanding

YOU understand, agree and acknowledge that these Terms are not stand alone provisions governing YOUR relationship with Legal MD. The Terms read with the Agreement, and such other ancillary documents as referred to in the Agreement, constitute the entire understanding. In the event of any conflict between the provisions of these Terms and the provisions of the Agreement, the provisions of the Agreement shall prevail.

6. General

The Services shall be provided to YOU subject to these Terms and as per the terms and conditions framed with respect to the Agreement. These Terms are in addition to and not in derogation of any specific terms and conditions framed for the Services and the Policy respectively. These Terms shall be governed by Laws of India and YOU agree to submit to the jurisdiction of courts in New-Delhi, India.
*PI policy is a bundled offer & custom designed for LegalMD members; policy will be issued within 30 days after payment clearance
*Compliance of documents is a package offer, any additional document audit will be chargeable @Rs. 2000 per hr, of time spent by Legal Team
*Crisis support will include PR support from our partnered PR agency, only in case any Member’s medico negligence case gets highlighted in media
*Other Legal support is a package offer for one year, any additional legal requirements will be chargeable @Rs. 2000 per hr, of time spent by Legal Team
*We support you even before a formal case is filed in court. At threat, email or any communication from patient or his family, we initiate legal support. Please inform us asap.
*The Base services are strictly for Medico-Negligence issues only and only for those issues which arise post signing with us & for treatments done post payment clearance to LegalMD
*Services continue post sign-up period only if renewal of services is done & insurance company agrees to continue to insure you
*In no circumstance does our Legal Team or any other team visit your office, for any of the services or situation. Services are over phone, at our office or online. In-person or visit to your office will be at extra charges
-Retroactive benefits continue as per T&C’s of both new & previous insurance policies & only if there is no break in between

7. Disclaimer

By using this site you accept the terms and conditions mentioned in this disclaimer. Legal MD does not evaluate or guarantee the accuracy or success of any services given by Insurance Company and the Insurance Broker, whether under these Terms or the Agreement or otherwise. Legal MD further affirms that the Policy is being provided to YOU at ‘cost’ and no incremental margin or commision. Legal MD assumes no liability or responsibility for any errors or omissions in information on the website www.LegalMD.in (Site;). Legal MD expressly disclaims any warranty, regarding the Site and all services, including any implied warranty of failure of performance if any. In no case directors, employees or other officers of Legal MD can be held liable for any loss, damage, or inconveniences whatsoever or howsoever suffered, directly or indirectly by any person/user as a result of their use of this Site and of any information and contact details supplied on the Site.

The Site shall be updated at regular intervals and it shall be YOUR obligation to keep yourself updated with the changes/modifications introduced on the Site. It shall be deemed that YOU have, at all times, been abreast with any and all such changes/modifications.

Notwithstanding anything to contrary, Legal MD reserves the right to refuse/cancel: (i) a membership; (ii) a new membership; and/or (iii) renewal of a membership.
