Vague statement of collective negligence not sufficient to proceed against doctor

31 July, 2014

In almost a decade old case of medical negligence, which resulted in the death of Lakshmi Santhosh, the high court quashed the case against Dr Bhaskaran Ravikumar, who was arrayed as the fourth accused in the case, saying there was no material to show that the petitioner had treated or prescribed medicines to the patient, or attended to her before he saw her in a morbid stage. In a judgement delivered on December 24, 2012, the consumer forum directed the casualty doctor, the gynaecologist, and the surgeon to pay Rs 15 lakh.
