PUDUCHERRY: Overruling the verdict of the District Consumer Disputes Redressal Forum in a case of medical negligence, the State Consumer Disputes Redressal Commission ordered an anesthesiologist to pay Rs 15 lakh compensation to the kin of a deceased patient here on Sunday.
The Bench comprising the Commission’s president Justice K Venkataraman, members K K Ritha and S Tirougnanassambane passed the order at a sitting here.
In the order, K K Ritha noted that the simple anaesthetic procedure before surgery was performed carelessly, thereby tipping the patient’s condition beyond the control of the specialist concerned.
The case relates to one Kanniakumar, who was diagnosed with gallstones and scheduled for surgery, in a private clinic, by a urologist in 2002.
On July 27, the patient was prepped for surgery by a specialist and the anesthesiologist. But with the patient developing cardiac unrest, they had to summon a cardiologist, who declared that the patient died some time ago.
Subsequently, Kanniakumar’s relatives staged a protest and filed a criminal case besides filing a complaint with the District Consumer Disputes Redressal Forum here. The forum dismissed the case, but the family filed an appeal, which led to the present hearing and verdict by the State Consumer Disputes Redressal Commission.
